تحقیق و توسعه در حقوق تطبیقی (از تغییر نام نشریه تا تغییر در اهداف، رویکرد و محتوا)

چکیده

تاکنون 19 شماره از فصلنامه پیش‌رو با عنوان "فصلنامه دانشنامه‌های حقوقی" منتشر شده است. در تابستان 1402 این فصلنامه با عنوان جدید "تحقیق و توسعه در حقوق تطبیقی" منتشر شد. از آنجا که این تغییر، صرفاً یک تغییرِ نامِ ساده نبوده است؛ و اهداف، رویکردها و محتوای نشریه را تحت تاثیر قرار داده است، شایسته بود که توضیحاتی در خصوص این تغییر نام ارائه شود که متاسفانه مجالی فراهم نشد؛ اکنون و بنا به تقاضای برخی از استادان و خوانندگان گرامی، توضیحاتی در خصوص معنای مورد نظر از "تحقیق و توسعه در حقوق تطبیقی" بیان شده و جزئیات بیشتری از الزامات این تغییر نام، ارائه می‌شود. اهمیت و ضرورت این توضیحات موجب شد که حجم این یادداشت بیشتر از حجم متعارف سرمقاله‌های رایج در نشریات علمی گردد و لذا این یادداشت در قالب سایر گونه‌های مقالات علمی شناخته شده در بند2-5 آیین‌نامه نشریات علمی و با اندکی تفصیل ارائه می‌شود.
لذا در این سرمقاله، توضیح می‌دهیم که با تغییر عنوان فصلنامه:
* چه مفهومی مورد نظر است؟
* چه اهدافی دنبال می‌شود؟
* تحقیق و توسعه در حقوق تطبیقی چه اهمیت و ضرورتی دارد ؟
* انجام این گونه مطالعات تطبیقی، چه آثار، فواید وکارکردهایی دارد؟
* این مطالعات چه زمینه‌ها، شاخه‌ها و اولویت‌هایی دارد؟
* این مطالعات با چه موانع و مشکلاتی مواجه است؟
* چه رویکردهایی مورد تأکید نشریه است؟
* نحوه همکاری با نشریه چگونه است؟
امید آنکه با پاسخ به این پرسش‌ها، زمینه مشارکت بیشتری با استادان حقوقی داخل و خارج کشور فراهم شود.

From changing the name of the journal to changing its goals, approach, and content

This journal used to be called "Legal Encyclopedias Quarterly," and it has published 19 issues so far. But in the summer of 2023, it got a new name: "Research and Development in Comparative Law." This change was not just restricted to the name. It affected the approaches, objectives, and content of the journal. Unfortunately, we didn't have the space to explain to provide an explanation regarding this name change.
Now, at the request of certain professors and devoted readers, clarifications about the intended meaning of "Research and Development in Comparative Law" are offered, as well as more specifics about the conditions of this name change. Because of the importance and necessity of these explanations, the size of this note is larger than the usual size of editorials in scientific journals; thus, this note is presented in the form of other types of scientific articles, as defined in paragraph 5-2 of the regulations of scientific journals, and in some detail.
In response to these questions, explanations are provided about:
 

What is the intended meaning?
What objectives are pursued?
What is the importance and necessity of research and development in comparative law?
What effects, benefits, and functions do such comparative studies have?
In what areas, branches, and priorities do these studies exist?
What obstacles and problems do these studies face?
What approaches does the journal emphasize?
How is collaboration with the journal done?

The answers to these questions indicate that the most emphasized approaches of the journal are:
- Comparing domestic and international laws to identify their strengths and weaknesses and proposing improvements for the efficiency of domestic laws in Iran.
- Conducting jurisprudential case studies by examining legal cases in different countries in various legal branches.
- Studying the legal history of different countries and the process of changes and developments in the laws and rights of other countries, proposing improvements for domestic law in Iran.
- Examining legal theories and studying new ideas and concepts, and comparing them with the culture, traditions, and accepted norms of Iranian-Islamic society.
- Utilizing the experiences of international organizations to improve laws and regulations at the national level in Iran.
- Studying the experiences of other countries to identify the best methods and creative solutions to legal issues in Iran, aiming to better understand foreign nations.
- Fundamental legal research and attention to general principles and the philosophy of law.
It also responds to the mentioned questions that the most important features of the articles accepted by the journal are:
Articles that used comparative legal studies to identify and analyze current legal concerns in Iran at three levels: applied, developmental, and basic.
Articles aiming at improving and amending laws and increasing the efficiency of the legal justice system utilizing research findings from studies.
 
Articles proposing new remedies based on other nations' experiences, as well as inventive solutions to contemporary legal difficulties in Iran, to increase the quality and efficacy of Iranian law.
Articles focus on developing the boundaries of comparative law by finding legal areas of collaboration between countries, universities, and legal organizations.
Research focusing on conflict prevention in national laws demonstrates areas of compatibility and legal harmonization while conserving cultural differences.
Articles aimed at increasing public trust in the legal system, rationalizing the law, and improving the relationship between people and the judicial and socio-political system.
Research demonstrating mechanisms for identifying and responding to the legal needs of Iranian society.
Research shows mechanisms to reduce conflict levels and increase the ability of the dispute resolution system in Iranian society.
Research shows mechanisms for the use of new technologies such as artificial intelligence, data analysis, hyperorganizational methods, and identifying and generalizing standards and experiences of other countries.
Articles that focus on a comparative examination of laws and legal systems lead to identifying the strengths and weaknesses of each system and amending it.
 
Studies that identify the mechanisms of social change acceptance and management and give a foundation for their conformity with the ancient foundations and traditions of Iranian Islamic society.
The hope is that by answering these questions, the groundwork for increased participation with legal scholars inside and outside the country will be provided.
