But accuracy in this weird book shows that except for one case, this scholar doesn't mention to "separation" in the text of his book. Interestingly the system that under the influence of it, he wrote "The Spirit of Laws" (the British at the time) didn't base on the separation of powers in such a way that attributed to him. In addition to the lack of separation of powers in the content as a word, whatever from tenor of "The Spirit of Laws" is decent for conclusion is: "balance of powers no separation of them". Montesquieu in the whole of his book -especially in the Chapter VI of the book XI- praised the political freedom caused by the balance of triple powers. So it can be said neither those who have admired him as the inventor of the separation of powers nor those who have attacked him for same reason, has not been a fair understanding of what Montesquieu has said about division and balance of powers. This paper intends to illustrate the true idea of Montesquieu by examine the evolution of the separation of powers and a new narration of the book "The Spirit of Laws".}, keywords = {The separation of powers,The balance of powers,The Spirit of Laws,Montesquieu}, title_fa = {تفکیک یا تعادل قوا؛ خوانش جدید از کتاب روح‌القوانین مونتسکیو}, abstract_fa = {مدت‌های مدیدی است که هر جا سخن از تفکیک قوا به میان می‌آید، نویسندگان بلافاصله به نام شارل دو مونتسکیو به عنوان مؤسس این نهاد در حقوق عمومی اشاره می‌کنند و طبیعتاً به معروفترین اثر وی یعنی «روح القوانین» نیز به عنوان منبع تأسیس این نهاد، استناد می کنند. این استناد به حدی است که گویی تفکیک قوا، زاده مونتسکیو است. اما مداقه در این اثر شگرف مونتسکیو نشان می دهد که این اندیشمند به جز یک مورد، در هیچ‌کجای متن کتاب خویش به عبارت «تفکیک» در ارتباط با قوا اشاره‌ای ندارد. جالب اینجاست که نظامی که او تحت تأثیر آن روح القوانین را به رشته تحریر درآورده است،(نظام انگلستان وقت) نیز مبتنی بر تفکیک قوا به گونه‌ای که به شخص وی نسبت ی‌دهند، نبوده است. علاوه بر فقد لفظ تفکیک قوا در متن، آنچه از روح کلی روح القوانین قابل استنتاج است، توازن و تعادل قواست و نه تفکیک قوا. مونتسکیو در جای جای اثر خویش -علی الخصوص در فصل ششم از باب یازدهم- آزادی سیاسی ناشی از تعاون و توازن قوای سه گانه را می‌ستاید. بنابراین می‌توان گفت نه آنهایی که او را به عنوان مبدع تفکیک قوا ستوده-اند و نه آنهایی که بر او به همین عنوان تاخته اند، فهم درستی از آنچه مونتسکیو در باب تقسیم و توازن قدرت داشته است، نداشته اند. این مقاله بر آن است تا با بررسی سیر تحولی تفکیک قوا و خوانش جدید از کتاب روح القوانین، ایده واقعی مونتسکیو را در این باب بیان نماید.}, keywords_fa = {تفکیک قوا,تعادل قوا,روح القوانین,مونتسکیو}, url = {https://jcl.illrc.ac.ir/article_247926.html}, eprint = {https://jcl.illrc.ac.ir/article_247926_30e5be54becdd7959ee4a8f6c76b9d71.pdf} }
